Généralités

Cadre institutionnel

L’accession à la propriété foncière (souvent confondue avec la propriété terrienne) est l’objectif poursuivi par l’Etat de Côte d’Ivoire vis-à-vis des usagers dans sa politique foncière, à travers les réformes qu’il initie à juste titre et soutenues, pour ce qui relève du domaine foncier urbain, par les textes suivants :

  • le Décret-loi du 26 juillet 1932, portant réorganisation du régime de la propriété foncière en Afrique Occidentale Française ; 
  •  
  • la Loi n°61-84 du 10 avril 1961, relative au fonctionnement des départements, préfectures et sous-préfectures ;
  • la Loi n° 62-253 du 31 juillet 1962, relative aux plans d’urbanisme ;
  • la Loi n°71-340 du 12 juillet 1971, réglementant la mise en valeur des terrains urbains détenus en pleine propriété ;
  • l’Ordonnance n°2011-262 du 28 septembre 2011 d’orientation sur l’Organisation Générale de l’Administration Territoriale de l’Etat ;
  • l’Ordonnance n° 2013-481 du 02 juillet 2013, fixant les règles d’acquisition de la propriété des terrains urbains ;
  • le Décret n°71-341 du 12 juillet 1971, fixant les modalités d’application de la loi n°71-340 du 12 juillet 1971, réglementant la mise en valeur des terrains urbains détenus en pleine propriété ;
  • le Décret n° 74-265 du 19 Juin 1974, portant délégation de pouvoirs des Ministres aux Préfets ;
  • le Décret 2011-263 du 28 septembre portant organisation du territoire national en districts et en régions ;
  • le Décret n° 2012-939 du 26 septembre 2012, portant nomination dans les fonctions de Préfets de Région et de Préfets de Département ;
  • le Décret n° 2013-482 du 02 juillet 2013, relatif aux modalités d’application de l’Ordonnance fixant les règles d’acquisition de la propriété des terrains urbains ;
  • l’Arrêté n° 2164 du 9 juillet 1936 modifié par l'Arrêté n° 83 du 31 janvier 1938, réglementant  l’aliénation des terrains domaniaux ;
  • l’Arrêté n°100/MCLAU/DGUF/DAJC/DDU du 16/09/13, portant mise en œuvre du Décret n°2013-482 du 02 juillet 2013 déterminant les modalités d’application de l’Ordonnance n°2013-481 du 02 juillet 2013, fixant les règles d’acquisition de la propriété des terrains urbains.

Ainsi, s’appuyant sur le ce cadre institutionnel légal, le Ministère en charge de l’urbanisme travaille d’arrache-pied pour être plus proche des usagers par l’accomplissement de sa mission qui est d’assurer :

  • la gestion du secteur de l’assainissement et du drainage ;
  • la gestion du foncier urbain ;
  • la modernisation de l’Administration en charge de l’urbanisme, du foncier et de l’habitat ;
  • l’encadrement des professions intervenant dans le domaine de l’urbanisme, du foncier et de l’habitat ;
  • la promotion de l’accession à la propriété foncière ;
  • la promotion de l’accession à la propriété immobilière ;
  • l’assistance aux collectivités locales en matière de foncier notamment de rénovation et de restructuration de quartiers urbains ;
  • la maîtrise d’ouvrage délégué en matière de construction pour le compte de l’Etat.   

L’une des nombreuses prérogatives du MCLAU étant de permettre à tous usagers, par des procédures réaménagées et améliorées d'accéder à la pleine propriété, gage d'une sécurité foncière garantie, a, à cet effet, instruit tous ses services territoriaux animés par des Agents chevronnés, d'en faire leur leitmotiv.

C'est pourquoi, il est souhaitable et même recommandé de se familiariser avec certaines terminologies usuelles dans le domaine foncier urbain qui se déclinent en trois (3) points essentiels :

  • - Le contexte de l’accession à la propriété foncière ;
  • - Les procédures mises en place pour accéder à la propriété foncière ;
  • - Les avantages liés à l’accession à la propriété foncière.

Mais avant d'aborder ces trois chapitres, permettons-nous de donner quelques définitions de certains mots ou expressions employées régulièrement par les professionnels du domaine foncier qui laissent coi l'usager qui n'arrive pas à cerner souvent leur contour.

Mais avant tout propos et pour une bonne appréhension du thème du jour, nous allons d’abord chercher à comprendre ce qu’on entend par domaine de l’Etat, un terme très usité.

DEFINITIONS

1- Domaine de l’Etat

De façon générale, nous devons savoir que les textes qui régissent le domaine foncier urbain en Côte d’Ivoire sont hérités de la colonisation. Ils constituent le socle des règlements et dispositions factuels qui sont appliqués.

Dans notre étude, seul le domaine privé nous intéressera et ce, au regard du décret du 30 août 1900 sur le régime des terres domaniales en AOF et rappelé par le décret du 15 novembre 1935.

Il est utile de rappeler ce cadre juridico-administratif qui donne plein pouvoir à l’Etat pour tout ce qui est de la propriété foncière. L’article 1er dudit décret souligne le principe de l’appartenance à l’Etat, des terres vacantes et sans maître ainsi que les terres ne faisant pas l’objet de titre foncier régulier de propriété ou de jouissance et également les terres qui sont inexploitées ou inoccupées depuis plus de dix (10) ans.

Il est de même bon de savoir que les terres ivoiriennes sont reparties en deux (2) grandes catégories : celles appartenant à l’Etat et celles appartenant aux particuliers.

  • Les terres appartenant à l’Etat :

Les terres appartenant à l’Etat constituent le domaine de l’Etat. Il est à son tour subdivisé en deux (2) grandes parties :

  • Le Domaine privé de l’Etat ;
  • Le Domaine public de l’Etat.
  • Font partie du domaine privé de l’Etat, les immeubles bâtis ou non bâtis appartenant à l’Etat et qui ne sont pas affectés à l’usage du public. Il s’agit notamment :
    • des bâtiments administratifs ;
    • des terrains destinés au lotissement ;
    • des terrains en zone rurale.

On distingue également deux (2) types de domaines privés de l’Etat :

  • le domaine privé de l’Etat dans les zones rurales géré par le Ministère de l’Agriculture ;
  • le domaine privé de l’Etat dans les zones urbaines géré par le Ministère de la Construction, du Logement, de l’Assainissement et de l’Urbanisme.
  • Font partie du domaine public de l’Etat, les rivages de la mer jusqu’à une certaine limite (100 m) ; les cours d’eau navigables ou flottables (25 m) ; les sources et cours d’eau non navigables ni flottables ; les lacs, étangs et lagunes (25 m) ; les nappes aquifères souterraines quelle que soit leur provenance, leur nature et leur profondeur ; les canaux de navigation et leur chemin de halage ; les canaux d’irrigation et de dessèchement et les aqueducs exécutés dans un but d’utilité publique, ainsi que les dépendances de ces ouvrages ; les lignes télégraphiques et téléphoniques et leurs dépendances ainsi que les aériens des stations radioélectriques, y compris leurs supports encrages, les lignes d’alimentation appareils de couplage ou d’adaptation et leurs dépendances ; les chemins de fer, les routes, les voies de communication de toute nature et les dispositions de protection de ces voies, les conduites d’eau, les conduites d’égouts, les ports et rades, les digues maritimes et fluviales, les ouvrages d’éclairage et de balisage, ainsi que leurs dépendances ; les ouvrages déclarés d’utilité publique en vue de l’utilisation des forces hydrauliques et du transport de l’énergie électrique ; les ouvrages de fortification des places de guerre ou des postes militaires, ainsi qu’une zone large de 250 mètres autour de ces ouvrages ; les servitudes de passage sur des terrains et bâtiments privés ; etc.
  • Les terres appartenant aux particuliers :

Il s’agit des terres ou parcelles qui ont fait l’objet d’immatriculation au nom de l’Etat, en tant que concessionnaire avant de les vendre aux demandeurs (personnes physiques ou morales).

2- Accession à la propriété foncière

Dans le domaine foncier urbain, l’accession à la propriété foncière se définit comme étant toutes procédures légales permettant à tous usagers de bénéficier de tous les droits d’usus, fructus et abusus sur un bien meuble ou immeuble et d’en avoir la capacité de prouver ce droit par un acte administratif ayant une portée juridique, dûment signé par une autorité administrative compétente.

Pour faire simple, il s’agit d’avoir le droit de posséder et d’user d’un bien totalement et en exclusivité. Cependant, comment y accéder constitue l’objet essentiel développé dans le chapitre "Procédures d'accession à la propriété foncière".
